Globalization has become the cliché of our times. The neo-liberal virus has struck almost everybody including within the ranks of the left. The proponents of neo-liberal globalization claim that it produces “accelerated efficient” development along with deepening of democracy and human rights. However, reality shows the opposite and any rigorous examination of such frivolous arguments reveals their shallowness and inconsistency. Social progress and democracy cannot move ahead but jointly and on the condition that we move away from the dogmas of neo-liberalism.
The book underscores that the current disasters are not the “price” to pay for a transition towards the promised paradise, but on the contrary are bound to deepen as long as neo-liberal economic policies are pursued. Instead of focusing on past debates, the book makes a critical analysis of several contemporary debates related to globalization. With the help of case studies, statistical data and cogent analysis, the book debunks several myths associated with the globalization processes.

Le Centre sur les droits au logement et les évictions (COHRE) est l’une des principales ONG actives au plan international pour faire connaître et avancer les droits économiques, sociaux et culturels (DESC). Depuis quinze ans, ces droits, longtemps restés marginaux par rapport aux droits civils et politiques, ont fait l’objet d’une attention nouvelle de la part des Etats, des organisations internationales mais aussi des organisations de la société civile. Une des facettes de ce phénomène a été la multiplication des actions en justice intentées pour faire respecter ces droits.
Dans cette publication, COHRE propose une vue d’ensemble de cette nouvelle tendance à recourir aux instances judiciaires pour faire protéger et réaliser les DESC. Il a pour cela interviewé près de 50 personnes (avocats, responsables d’ONG, juges, etc.) de 17 pays différents afin de tirer les leçons de leurs expériences. A chaque fois, quatre questions principales ont été abordées :
Il en résulte un dossier d’une très grande richesse, à la fois conceptuelle et pratique. Ce document propose en effet une quinzaine de chapitres consacrés chacun à un pays différent et couvrant les cinq continents. Ils présentent de manière détaillée à la fois une description et une analyse approfondie d’une ou plusieurs actions en justice qui ont permis de promouvoir les DESC. Les chapitres suivants examinent le fonctionnement de divers instances de recours internationales (Comité des droits de l’homme des Nations unies, Organisation internationale du travail, Panel de la Banque mondiale, etc.) ainsi que plusieurs actions en justice engagées pour mettre en cause la responsabilité des entreprises multinationales. Ce document tire les leçons de toutes ces expériences dans son introduction : il souligne ainsi l’immense potentiel des actions en justice dans la mise en œuvre des DESC, les résultats effectifs qui peuvent en être attendus mais aussi les obstacles et les limites auxquels est confrontée cette forme d’actions.
